1. Agreement to Terms
Welcome to AIGenStudio. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client," "you") and AiGenStudio ("Studio," "we," "us") concerning your access to and use of our website as well as our professional virtual fashion photography services.
By commissioning any service from us, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using our services and must discontinue use immediately.
2. Description of Services
AiGenStudio provides a comprehensive suite of high-end digital imagery services, including but not limited to:
Virtual Fashion Photography: Creating photorealistic images of apparel on digital models or in virtual environments.
3D Apparel Visualization & CGI Clothing Photography: Transforming your digital patterns (e.g., CAD files) into high-fidelity 3D renderings for e-commerce, marketing, and prototyping.
Digital Lookbook and Campaign Creation: Designing and executing complete visual narratives for your collections.
E-commerce Product Photography: Producing clean, consistent, and high-quality product-on-white (POW) or styled imagery for online retail platforms.
3. Ethical Standards & Prohibited Content
AiGenStudio is committed to fostering positive, safe, and artistically responsible brand messaging. Our studio upholds a strict ethical standard and will not engage in the creation of any content that:
Is pornographic, explicitly sexualized, or exploitative.
Promotes or depicts suicide, self-harm, or eating disorders.
Contains gratuitous violence, gore, or celebrates harmful acts.
Constitutes hate speech or promotes discrimination against any group.
Is illegal, fraudulent, or violates the rights of others.
We reserve the sole and absolute right to refuse or terminate any project that, in our professional judgment, violates these ethical standards. By commissioning our virtual fashion photography services, you agree that your project request complies with this policy.
4. The Creative Process & Client Responsibilities
A successful collaboration requires clear input and timely feedback. The Client agrees to provide:
A Comprehensive Creative Brief: Including mood boards, brand guidelines, styling notes, and specific shot lists.
All Necessary Digital Assets: Including 3D models of garments (.obj, .fbx, etc.), digital fabric files, and any required graphics or logos.
Timely Feedback: Feedback and approval at each stage of the project (e.g., initial renders, revised renders) must be provided within the agreed-upon timeframe.
Our standard project fee includes One comprehensive rounds of reasonable revisions. Additional revisions or significant changes in creative direction after project commencement will be subject to additional fees.
5. Payment and Billing Terms
A 100% upfront payment of the total project fee is required to confirm your order and immediately commence work. Payments are accepted via Razorpay (for Indian clients, quoted in INR) and PayPal (for foreign/international clients, quoted in USD).
If, for any reason, a client's expectations are not met, we offer a partial refund of 95% of the total investment, provided the claim is made prior to the delivery of the final, high-resolution, unwatermarked images. Once final, unwatermarked images are delivered, no refunds will be granted.
6. Intellectual Property Rights & Usage
This is the cornerstone of our creative partnership.
Ownership of Final Deliverables: Upon receipt of full and final payment, the Client is granted an exclusive, perpetual, worldwide license to use the final delivered images for their specified purposes (e.g., website, social media, print campaigns).
Studio's Portfolio Rights: AIGenStudio retains the right to use the final images in our portfolio, on our website, on social media, and in other marketing materials for our own self-promotion. We will honor any reasonable pre-agreed upon embargo periods for collection launches.
Ownership of Raw Files & Preliminary Work: We retain ownership of all preliminary concepts, unused renders, working files, 3D scenes, and proprietary techniques used in the creation of the work. Raw project files are not delivered to the Client unless agreed upon in writing for an additional fee.
7. Confidentiality
Both the Studio and the Client agree to treat all proprietary information received from the other party as confidential. This includes unreleased product designs, marketing plans, and business strategies. We will not disclose your confidential information to any third party without your prior written consent. 8. Term and Termination
This agreement begins when the Client pays the initial deposit and terminates upon delivery of the final assets.
Either party may terminate the agreement if the other party is in material breach of these Terms.
If the Client terminates the project for convenience before completion, the initial deposit will be forfeited. The Client will also be responsible for payment for all work completed up to the date of termination.
9. Limitation of Liability
Our liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us for the specific service at issue. For more information, please review our Discliamer Page.
10. Governing Law and Dispute Resolution
These Terms and your use of our services are governed by and construed in accordance with the laws of Governing Law of India. Any disputes arising from this agreement shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached, the dispute shall be submitted to binding arbitration in Ranchi(Jharkhand), India.
11. Changes to These Terms
We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time. The "Last Updated" date will be revised, and it is your responsibility to periodically review these Terms.
